ArchGenerator Terms of Use

1. Who provides the service and which version applies

ArchGenerator, available at archgenerator.com, is operated and provided by DSTRATEGY LLC, located at 13809 Research Blvd. Suite 500 Austin, TX 78750 - USA. In these Terms, “ArchGenerator,” “we,” and “us” mean DSTRATEGY LLC. Payments are made to DSTRATEGY LLC, which is responsible for the corresponding receipts and invoices.

These Terms govern your access to and use of ArchGenerator and purchases of its software-as-a-service (SaaS) offering from DSTRATEGY LLC, a U.S. company based in Austin, Texas. DSTRATEGY LLC is your service provider and contracting party. The website and application are collectively the “Platform.” “Customer” means the individual or organization purchasing or using the service; “User” means a person authorized to use the Customer’s account. Language selection does not change the contracting party or remove rights under applicable mandatory law.

You accept these Terms when completing the applicable registration or purchase acceptance step. If acting for an organization, you confirm that you have authority to bind it. You must be at least 18 and legally able to enter the contract. The Privacy Policy explains our processing of personal information; accepting these Terms is not blanket consent to every processing activity.

Specific conditions concerning scope, quantity, price, duration, and other commercial terms will appear in the offer, order, proposal, or contract expressly accepted by the customer. Those documents supplement these Terms regarding the specific purchase conditions, subject to mandatory rights and applicable data-protection rules. The existence of a proposal does not mean that it has been accepted.

Standard use of ArchGenerator is governed by these Terms and the offering you accept; it does not require a separately negotiated commercial contract. Confidentiality, intellectual-property, security, source-code handling, and privacy commitments apply from the first use, including any free evaluation offered. A free evaluation does not authorize paid charges or automatic conversion to a paid subscription without your express acceptance of the applicable purchase conditions.

Additional service levels, dedicated support, integrations, and other customer-specific conditions may be agreed separately. They do not apply unless expressly accepted and cannot retroactively reduce rights or override mandatory protections. Where an activity requires specific legal safeguards or binding contractual arrangements, those requirements must be satisfied before that activity begins, including during an evaluation. This requirement concerns the affected processing, not an automatic obligation to negotiate a separate commercial contract merely to create an account.

2. What ArchGenerator provides

ArchGenerator is a software architecture intelligence platform. Depending on the purchased features and authorized inputs, it supports technical diagnostics of existing software, architecture and dependency analysis, code-health and security findings, database-structure and infrastructure assessments, prioritized remediation recommendations, and specifications for corrections and product evolution. It organizes requirements, architectural decisions, acceptance criteria, and test guidance into specification-driven development (SDD) kits for use by your team and your preferred coding tools. Outputs may include reports, structured findings, architecture graphs, specifications, and downloadable kits in the formats available for the selected service. Your plan or accepted order identifies included features, usage limits, credits, and billing cycles. Roadmap items and features labeled as forthcoming are not included unless expressly contracted.

The service may use artificial intelligence to support analysis, subject to the source-code restrictions in Section 3. Results may require contextual and professional review before implementation.

ArchGenerator supports the decisions and specifications that guide implementation; it is not a coding agent. Generating an SDD kit or test guidance does not mean that changes have been deployed or that tests have been executed in your environment. You remain responsible for authorizing implementation, reviewing outputs, and validating the resulting software. Results depend on the scope, quality, completeness, permissions, and technical compatibility of the inputs. No specific productivity gain, token reduction, security outcome, or regulatory approval is guaranteed.

Human review or certification, where offered, requires a separate engagement with DSTRATEGY LLC. A report is certified by a person only when the purchased service expressly includes that step. Analysis supports professional judgment; your organization remains responsible for evaluating recommendations and approving changes to its systems.

3. Source code: access without retention

3.1. Temporary processing only

You authorize access to and processing of code solely to perform the analysis you request. You retain your intellectual-property rights; this operational permission does not transfer ownership or grant any right to exploit the code for another purpose.

Code is processed exclusively in isolated, volatile memory within a disposable analysis environment. We do not write code to persistent disks, databases, object storage, persistent caches, backups, snapshots, or logs. A repository is not retained as a permanent clone. These restrictions apply during processing as well as afterward.

When an analysis completes, is canceled, or fails, its code is immediately discarded and the temporary processing environment is destroyed. Cancellation or failure does not create a separate retention period. We do not retain source code for debugging, support tickets, benchmark datasets, or subsequent analysis.

3.2. Reports, providers, and artificial intelligence

Reports do not contain literal code snippets. Findings may identify file paths, line references, structural relationships, and analysis metrics without reproducing code. We do not use your code to train or improve artificial-intelligence or machine-learning models. Third parties, partners, and subprocessors are not given access to your source code.

To perform the analysis you request, we may send limited non-code information to AI models and their providers, such as necessary technical context, structural metadata, and findings. These inputs must not contain literal source code or representations that permit its reconstruction. We limit the information to what the requested analysis needs and exclude access credentials and unnecessary secrets.

Depending on its content, non-code information may include personal or confidential information; it is not automatically anonymous. Its processing remains subject to the applicable legal basis, confidentiality, security, and data-protection requirements described in the Privacy Policy. Sending this information is authorized exclusively to perform the requested service and transfers no rights to exploit it independently.

Information received from customers or generated from it, including personal information, technical context, reports, metadata, and other results, will not be used for training, fine-tuning, or improving artificial-intelligence or machine-learning models, whether our own or our providers'. ArchGenerator will require its service providers to comply with this restriction. Processing information to produce the requested analysis does not authorize training. The statistical use of metrics permitted in Section 4 does not override this prohibition.

Non-code results made available to the customer, including reports, metrics, structural metadata, and dependency graphs, are kept in the database instance associated with that customer for consultation and use of the service. Their retention and deletion follow Section 6 of the Privacy Policy. Account information and administrative, tax, and security records have their own purposes and criteria. None of these circumstances authorizes retention of literal source code or representations that permit its reconstruction.

3.3. Repository connections and credentials

You may directly revoke access authorization granted to ArchGenerator at any time, in whole or in part as permitted by the integration's permissions. Revocation carried out by you takes immediate effect for the access concerned and prevents new reads and new analyses within that scope. Ongoing processing that depends on the revoked authorization will end without unjustified delay, with code discarded as described in Section 3.1. Temporary tokens are revoked or expire automatically according to the connection method. The connection identifies the means of revocation. Revocation does not delete completed reports or, by itself, cancel the subscription; reports remain accessible under the account rules unless you also request their deletion.

4. Ownership and permitted use of results

Code, data, and information supplied by you remain yours or the property of their respective rights holders. Access does not transfer ownership or grant a license for commercial exploitation. Your authorization to ArchGenerator is limited to processing necessary for the requested service, for the period corresponding to each purpose, and is revocable as to access to materials under Section 3.3. Retention of requested results and legally necessary records follows the Privacy Policy.

Reports and customer-specific results produced for you belong to you, subject to third-party rights and the Platform's preexisting components and technologies. ArchGenerator acquires no independent exploitation rights over your information by generating summaries, representations, or other intermediate artifacts. Confidential derived materials receive the same protection as their source information. Their existence does not authorize retention of code or representations that permit its reconstruction. Your rights over results do not transfer ownership of the Platform's preexisting technology, methods, or components and do not prevent use of reports for their contracted purpose.

ArchGenerator's preexisting technology, algorithms, analysis rules, templates, branding, and other Platform components remain the property of DSTRATEGY LLC and/or its partners and licensors. Ownership of a report does not transfer ownership of those underlying components.

We may use aggregated, effectively anonymized metrics for statistical assessment and improvement of the service, provided that they do not identify individuals or customers, expose confidential information, or contain or permit reconstruction of code. We will not use identifiable or confidential information to compare customers. This permission does not authorize training or fine-tuning models with the information covered by Section 3.2. Merely pseudonymized customer data does not qualify as anonymized information.

Nonpublic information received or generated through the service is protected against access, disclosure, and use incompatible with the contracted purpose. This protection covers code, business data, technical context, reports, and confidential intermediate artifacts. Confidentiality obligations continue after the relationship ends for as long as the information remains confidential. Legally required disclosures will be limited to what is necessary.

We will not publish, sublicense, commercialize, or reuse your confidential information or customer-specific results to create products or provide solutions to third parties. We will not reverse engineer them to appropriate or exploit your intellectual property. These restrictions do not prevent technical analyses and generation of results expressly requested by you, processing necessary for those analyses by service providers under the same restrictions, or the statistical use permitted above.

5. Your responsibilities

You must have the rights or authorization required to submit the repository for analysis, including any necessary authority to process information within it. Use access permissions appropriate to the requested analysis and keep account credentials secure. Inform us promptly of suspected unauthorized account access.

You must not use the Platform unlawfully, infringe another person's rights, interfere with its security or availability, share credentials with unauthorized people, scrape restricted content, reverse engineer the Platform, or attempt to extract proprietary analysis algorithms, except to the extent an applicable law protects a particular activity.

Do not place source code in support messages or attachments. Use the repository connection intended for analysis. If assistance requires discussion of a finding, provide the report reference and a description that does not reproduce code or expose credentials.

6. Plans, payments, and cancellation

6.1. Information before purchase

Before you confirm a purchase, we identify the plan or credit pack, price, currency, applicable taxes or how they are determined, billing interval, included credits, and renewal conditions. Your order confirmation records the purchased conditions. DSTRATEGY LLC receives payment; a payment processor may handle the transaction on its behalf.

6.2. Recurring subscriptions

Automatic renewal requires your express agreement to the recurring payment terms. Before that agreement, we disclose the recurring charge, interval, and cancellation method. We provide renewal notices and periodic reminders about the subscription, in accordance with the disclosed arrangement and applicable law. Notices identify relevant renewal conditions and how to cancel.

Unless a different minimum term is expressly agreed in your order, subscriptions have no minimum commitment beyond the current paid billing cycle. A promotional discount does not by itself create a minimum term. Coupon eligibility, activation deadlines, discount duration, covered charges, and the price payable after the promotion must be disclosed before purchase.

An increase in a recurring price or other material renewal condition is communicated in advance and does not retroactively change a paid cycle. We obtain additional agreement where required by applicable law. You may prevent the next renewal by canceling before it occurs.

6.3. Upgrades and downgrades

An upgrade takes effect immediately. The incremental price and additional credits for the remainder of the current cycle are prorated according to the time remaining; the complete price and credit allowance of the upgraded plan apply from the next cycle. The purchase screen shows the immediate charge, credit adjustment, and next renewal before confirmation.

A downgrade takes effect at the beginning of the next billing cycle. Your existing plan remains available for the already-paid period, and no prorated refund is issued for that period unless applicable law requires one. We display the next plan's price and credit allowance before confirming the downgrade.

6.4. Credits

Subscription credits are allocated by billing cycle and reset at renewal. Unused subscription credits do not carry over to another cycle. Separately purchased credit packs do not expire and are nonrefundable, except where applicable law requires a refund or another remedy. Subscription cancellation does not turn purchased credits into expiring subscription credits.

The Platform identifies the credit cost of an analysis or other chargeable operation before you authorize it. Your account shows the credits available under the applicable purchase conditions.

6.5. Canceling and requesting remedies

You may cancel online at any time through the same channel used to subscribe, directly in the Platform, without a telephone call or steps designed to obstruct cancellation. Cancellation stops future renewals; your current plan remains available until the end of the paid billing cycle. We provide confirmation identifying when renewal stops and when the current period ends.

Subscription payments and purchased credits are nonrefundable except where applicable law requires otherwise. Cancellation alone does not create a refund for a cycle already billed. These provisions do not restrict a statutory withdrawal or cancellation period, remedies for a defective or nonconforming service, or other rights that cannot legally be waived. The rights and conditions applicable in your country remain available; this document does not impose one country's withdrawal period on all customers.

For a qualifying distance service contract, consumers covered by EEA or UK withdrawal rules generally have 14 days from contract formation to withdraw. You may send an unequivocal withdrawal statement to our legal email, identifying yourself and the purchase concerned. No specific form or wording is required. Where applicable law requires an online withdrawal function, that function must also be available throughout the withdrawal period.

Starting service during the withdrawal period does not by itself eliminate the right. Any proportionate charge for service already performed requires the prior request and disclosures prescribed by law. Any loss of withdrawal rights after full performance, or under rules for qualifying digital content, requires the specific consent, acknowledgment, and confirmation mandated by the applicable law. Statutory refunds follow the applicable legal deadline and payment-method requirements. These rules concern statutory withdrawal, separately from stopping future subscription renewals.

Subscription cancellation does not automatically delete the account, results, or integrations. You may revoke access under Section 3.3, delete your results, and request account closure under the Privacy Policy. You may download available reports before deleting them or closing the account. Results in the database instance associated with you will be permanently deleted in that environment within 24 consecutive hours, as described in Section 6 of the Policy; that period does not authorize retention of code.

7. Availability, reports, and responsibility

We use commercially reasonable efforts to keep the Platform available and provide reasonable advance notice of scheduled maintenance. Continuous availability is not guaranteed.

Reports provide technical information and recommendations. They are not legal advice, a warranty that software will function correctly, or a certification of regulatory compliance. Findings may include false positives or false negatives, and an analysis may not identify every issue. Specialist review may remain necessary.

To the extent permitted by applicable law, the service is provided “as is,” subject to the express commitments in these Terms and your purchased offering. Nothing here removes statutory service guarantees or remedies that cannot be excluded.

Any contractual limits on liability must be stated expressly in an offer, proposal, or contract accepted by you and apply only in business relationships not subject to mandatory consumer-protection rules and to the extent legally valid. These Terms set no monetary cap on compensation. In the absence of a specific, validly agreed limit, liability will be determined under applicable law. The absence of payment does not exclude liability or imply a zero limit.

Liability will be determined under applicable law, taking into account damage, causation, and the parties' respective responsibilities. Where legally recoverable, compensation may include reasonable, documented expenses arising from third-party claims related to the event, subject to validly agreed limits and the exceptions below. A claim being made, or a penalty being imposed on you, does not automatically entitle you to reimbursement. ArchGenerator remains responsible for fulfilling its obligations in services entrusted to providers, without displacing each party's own legal responsibilities.

Contractual limits do not apply to intentional misconduct or gross negligence by ArchGenerator or its providers in performing the service, or to liabilities that the law does not allow to be excluded or limited. They do not restrict rights of individuals, authorities, or third parties not bound by these Terms, or limit compensation where applicable law prohibits doing so. Qualifications concerning the nature of analyses do not revoke express zero-retention and service commitments.

We will notify the customer without unjustified delay and within 24 consecutive hours after becoming aware of security incidents affecting its data or confidential information, including incidents that do not involve personal information. The initial notice will contain the facts then available and may be supplemented without waiting for the investigation to conclude. We will take containment and cooperation measures and provide relevant updates. Notices to competent authorities and affected individuals will follow applicable legal criteria and deadlines independently of this contractual notice to the customer.

8. Changes to these Terms

Material changes are communicated by email or through the Platform at least 15 days before taking effect, or earlier if a longer notice period is legally required. The notice identifies the effective date and provides access to the revised version. A change requiring your express agreement will not be treated as accepted merely because you continue using the Platform.

Other changes may take effect as indicated in the notice, subject to applicable law. You may cancel future renewals if you do not wish to continue under the revised conditions. Changes do not retroactively modify a completed purchase or remove mandatory rights.

9. Governing law and courts

Texas law governs these Terms to the extent that choice is permitted by applicable law. Disputes are submitted to the competent courts in Texas, United States, except where mandatory law gives you a different forum or makes that jurisdiction provision unenforceable.

This choice does not deprive a consumer of mandatory protections in the country or jurisdiction whose law applies to that consumer. It does not displace privacy laws that apply to our processing. The language in which you read these Terms does not change those rules.

11. Transparency and verification

On written request, we provide relevant information and available evidence about the measures applied to your processing, including information flows, retention, and deletion. The ordinary documentary response is free of charge and will be provided within 15 business days; shorter legal deadlines and urgent incident measures take priority.

We cooperate with legally required verification and with reasonable, substantiated requests to establish compliance. Verification protects security, service continuity, other customers' confidentiality, and third-party rights. It does not grant unrestricted access to infrastructure, credentials, or Platform code; those protections will not prevent legally required disclosure or adequate evidence of compliance.

Additional enterprise audit procedures, including scope, scheduling, independent auditors, and costs, may be agreed in a specific contract. A separate agreement is not a condition for exercising statutory rights, obtaining the ordinary documentary response, or receiving legally required cooperation.

12. Regional terms and business customers

12.1. Scope, language, and priority

The Platform is designed for business and professional use. That description does not waive consumer status or mandatory protections where they apply to a particular purchase. Regional provisions apply according to the relevant law, the Customer's circumstances, and the processing involved, not the selected language. The English and Spanish versions express the same agreement; neither version overrides a mandatory language requirement. Any inconsistency will be interpreted consistently with mandatory law and the parties' documented agreement, without reducing nonwaivable rights.

Any additional customer-specific contractual conditions supplement these Terms and do not authorize new processing purposes or weaken the source-code, confidentiality, or no-training commitments. Mandatory law and valid mandatory transfer instruments prevail where applicable. If a legally required condition cannot be satisfied within the agreed safeguards, the affected processing must not begin or must be suspended rather than silently relaxing them.

12.2. United States

Federal and applicable state rules governing subscription disclosures, authorization, renewal notices, cancellation, and remedies continue to apply. Where required, renewal consent is obtained separately from general acceptance and recorded. Any additional state-specific purchase disclosure is provided before the purchase. Texas law and venue under Section 9 remain subject to nonwaivable rights and applicable privacy laws; selecting Texas does not exempt the service from other states' requirements.

12.3. Canada

Mandatory federal and provincial consumer, privacy, language, and electronic-contract rules apply where their conditions are met. Any required copy of the agreement, renewal information, cancellation rights, and statutory remedies will be supplied in the prescribed form and time. For contracts subject to Québec's French-language requirements, the required French version of the contract and related documents must be made available before a valid choice of another language is obtained. These English and Spanish texts do not replace that obligation or constitute a waiver of it. Provincial rights are not replaced by a single nationwide cancellation period.

12.4. Mexico and Central America

Where applicable, the purchase process provides the supplier's identity and contact details, the complete price and currency, applicable charges, service scope, renewal terms, cancellation method, and an electronic record of acceptance. Local mandatory consumer rights and access to competent authorities remain available. For Mexico, this includes applicable consumer and electronic-commerce requirements. For Belize, Costa Rica, El Salvador, Guatemala, Honduras, Nicaragua, and Panama, the applicable country's rules govern; no uniform regional withdrawal period is imposed. Any country-specific disclosure or contract form required for a targeted offering must be provided before contracting. The service does not claim local incorporation, regulatory authorization, or certification by being available in that country.

12.5. European Economic Area, United Kingdom, and Switzerland

The withdrawal provisions in Section 6.5 apply to eligible consumer contracts. We provide required precontractual information, a durable copy or confirmation of the contract, and the prescribed withdrawal information and model form where required. Where national law implementing the EU online-withdrawal requirements applies, an accessible withdrawal function and acknowledgment must be available; a general support email does not replace a required interface. Mandatory remedies concerning conformity, necessary updates, service changes, termination, and refunds remain available under the applicable digital-service rules. EEA or UK withdrawal periods are not automatically extended to Swiss contracts; Swiss mandatory rules apply on their own terms.

12.6. EU data-processing-service switching

Where Chapter VI of the EU Data Act applies to the contracted service, we will support switching to another provider or on-premises infrastructure, and any legally protected parallel use. Before contracting, the service-specific switching schedule must identify exportable data and digital assets, available formats and interfaces, any justified exclusions, technical limitations, assistance, and the procedure for requesting switching. Trade-secret or intellectual-property exclusions may not obstruct legally required export of the Customer's data.

For a covered switching request, the notice period will not exceed two months and the ordinary transition period will not exceed 30 calendar days, subject to the Act's permitted extensions and required explanations. The Customer has at least 30 calendar days to retrieve exportable data after the transition, unless it instructs deletion sooner. We provide the assistance, continuity, security, and information required by the Act. Any extended transition, including technical infeasibility, must follow the Act rather than being imposed unilaterally. Any switching charge before 12 January 2027 is limited to what the Act permits and disclosed before contracting; no switching or data-egress charge is imposed from that date where prohibited. Ordinary service fees or a valid early-termination charge are not disguised switching fees.

A switching request does not by itself delete content or close the account. The Customer should keep its account and exportable non-code results available during retrieval. If the Customer expressly deletes content or closes the account, the existing 24-hour deletion commitment applies and the deleted content will no longer be available for export. Switching never authorizes retained source code: source-code disposal remains immediate at the end of processing, and only permitted non-code content is available for later export.
